One journey, two interlocking processes. The APPLICANT line runs the whole way: the applicant starts the no-fault divorce (D8), obtains the Conditional Order after a 20-week reflection period, resolves the finances (Form A onward), then applies for the Final Order LAST. The marriage ends only at the Final Order — and applying for it before finances are resolved can lose pension and inheritance rights, so an amber caution links the two. The applicant files Form A to ask the court to decide the finances; the court responds by issuing Form C, which fixes the First Appointment and the disclosure timetable. The centre 'Both parties' lane shows the steps both parties share — the Form E exchange, questionnaires, ES1/ES2, and the FDA, FDR and Final hearings both parties attend. The respondent acknowledges the divorce, then prepares their own cross-application (if any), s.25 statement and FDR position. Settlement can happen at any stage — a consent order with a Form D81 is approved on paper. After a final order, the payee can choose from several enforcement routes for unpaid sums; appeals (error of the court) and set-aside (Barder / non-disclosure) sit post-order.

Section 25 Matrimonial Causes Act 1973: The Court's Checklist

When determining financial remedy, the court must consider all circumstances of the case, with first consideration given to the welfare of any child of the family. Your bundle should address each statutory factor.

Section 25(2)(a): Income & Earning Capacity
